Farmaindustria supports the decision of the Government to appeal to the Constitutional Court the resolution of the service Andalusian of health (SAS) of the Junta de AndalucÃa which establishes the call of an auction for the selection of drugs to dispense by offices of the autonomous community in the event of prescription pharmacy active ingredient.
This decision to the Executive, as he reminded employers of the pharmaceutical industry in Spain, is in line with the opinions issued recently by the Council of State, which considered that “there is violation of the constitutional rules of distribution of powers between the State and the communities”.
But, in addition to invading own and exclusive constitutional powers of the State for the inclusion of medicines in the public pharmaceutical delivery and price fixing, understands that it also carries a “rupture of the equal access to the pharmaceutical provision recognised as minimum and common by State regulations”.
“auctions are one case of inequity between Spanish patients depending on the community in which they reside, causing the rupture of the unity of the pharmaceutical market and creating an imbalance in the pharmaceutical provision of the national system of health (SNS), implying a serious restriction of competition for pharmaceutical companies,” assured Farmaindustria.
